VISITING REGULATIONS
"COSMOS MUSEUM"

Thank you for your interest in the offer of the "Cosmos Museum" (hereinafter: "Museum"). Please read these Terms and Conditions (hereinafter: "Terms and Conditions") carefully before each visit to our Museum. The current Rules and Regulations are always available on the Museum's website (www.cosmosmuseum.pl) and additionally at the ticket office before the visit. The present Rules and Regulations set out the basic principles and rules applicable to all persons interested in visiting our Museum or participating in events organised at our Museum (hereinafter: "Visitors"). The rules and regulations contain basic information about the Museum, including the terms and conditions for purchasing tickets and visiting, as well as information about processing Visitors' personal data. We invite you to read the rules and regulations of the "Cosmos Museum" Team
§ 1. GENERAL PROVISIONS
1) The Museum is operated by the company COSMOS MUSEUM SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw (registered office address: ul. Łucka 15/3, 00-842 Warsaw), entered in the Register of Entrepreneurs of the National Court Register under the KRS number: 0000773004 by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register; share capital in the amount of: PLN 5000.00; NIP: 5272884234, REGON: 382653720.
2) Visitors can contact:

3) Visits to the Museum are possible during its opening days and hours. The current opening days and hours are posted at the entrance to the Museum.

§ 2. TICKET SALES, APPOINTMENT BOOKINGS
1) Visiting the Museum is possible on the basis of a valid document (hereinafter: "Ticket") entitling to a single admission to the Museum for specific exhibitions or events organised at the Museum. The exact scope and period of validity of a Ticket is determined by the description of the Ticket in question.
2) In the case of a Ticket with a visit reservation, it is important that the Visitor arrives punctually at the date and time of the visit included in his reservation. The Ticket becomes invalid 15 minutes after the booking time specified in it.
3) The ticket may be presented to the employee admitting Visitors to the Museum in any form (paper or electronic) allowing for an unambiguous verification of the unique number placed on it.
4) It is possible to purchase a Ticket remotely via the Museum's website (www.cosmosmuseum.pl) or in person at the Museum Ticket Office in accordance with the current price list valid on the day of payment for the selected Ticket. All available discounts and concessions are specified in the price list and are charged only upon presentation of a valid document confirming the holder's right to use the particular discount or concession.
5) Individual exhibitions and events held at the Museum may have separate regulations, with which the Visitor should become familiar each time before purchasing a Ticket covering a particular attraction.
6) Visitors should keep their Ticket or proof of purchase for the duration of their visit to the Museum.
7) Only the online booking of a visit date provides the Visitor with the opportunity to enter the Museum out of line at the chosen visiting time.
8) Pursuant to Article 38a(1) para. 12 of the Act of 30 May 2014 on consumer rights, the right of withdrawal from a contract concluded at a distance does not apply to a contract for the provision of services related, inter alia, to cultural events, if the contract specifies the day or period of service provision. Accordingly, Tickets purchased online with an appointment booking are not refundable after the booking time. The reservation referred to in the preceding sentence does not exclude or limit the statutory rights of the Visitor to complain about improperly provided services.
9) The terms and conditions of purchasing Tickets online may be additionally regulated by separate sales regulations available on the Museum's website, the acceptance of which is confirmed when making an online booking.
10) Due to the size of the Museum, the nature of the exhibitions and the related security requirements, the number of Visitors who can be in the Museum building at the same time is 50 (in words: fifty) persons. If this limit is reached, it is possible to withhold admittance to the Museum, and the queue of visitors waiting to enter the building is formed outside in front of the entrance to the building. For the sake of order and safety, all those interested in visiting the Museum should follow the instructions and orders of the Museum staff in charge of admitting visitors.
§ 3. MUSEUM RULES, SECURITY OF PERSONS AND PROPERTY
1) The Museum is not accessible to disabled people, in particular it does not have facilities such as lifts and wheelchair ramps.
2) Visitors should move around the Museum along the designated paths within the boundaries of the exhibition areas made available to Visitors. It is forbidden to use passageways and technical and service areas. Visitors shall also observe other orders and prohibitions resulting from signs and announcements posted in the respective exhibition zone.
3) Visitors are obliged to obey the instructions and directions of the Museum staff with regard to maintaining order and observing the safety rules on its premises.
4) The visitor shall be fully liable under the law for any damage caused through his/her fault on the Museum premises. All Museum property should be used only for its intended purpose. In the event of any damage through the fault of the Visitor, it is possible to charge the Visitor with the actual, justified costs of the damage incurred by the Museum.
5) Within the area of the Museum, it is allowed to view the exhibits within the limits of the accessible exhibition zones. It is forbidden to touch the museum exhibits, as well as any interference or attempts to remove or rearrange the fencing, barriers, etc. by Visitors.
6) Children under 13 years of age may be present on the Museum premises only when accompanied by adults who are responsible for ensuring that these Rules and Regulations are observed by them.
7) Chaperones of excursions and organised groups are obliged to keep an eye on their charges.
8) It is forbidden to damage, destroy or pollute the grounds or any part of the Museum property, including leaving litter.
9) Bringing and consuming alcoholic beverages and other drugs and smoking tobacco products, including e-cigarettes, on the Museum premises is prohibited.
10) It is forbidden to disturb order in any way, to behave in a disruptive manner, contrary to good manners and to disturb other Visitors visiting the Museum, in particular by:
a. bringing into the Museum luggage larger than 55 x 35 x 20 cm. Bags, luggage and other items may be brought in by parents and carers of children with medical problems;
b. to bring in objects which may cause inconvenience to other Visitors by being soiled or damaged, or which may soil or damage Museum property;
c. Entering animals without a leash and muzzle. Owners are liable for damage caused by the animal;
d. consumption of food and drink;
e. reliance on showcases;
f. running;
g. shouting;
h. entering prohibited areas;
i. touching equipment used to stabilise climatic conditions and equipment protecting the collection;
j. setting up a tripod, lamps, but also any other bulky items taking up a significant amount of display area space;
k. movement of trolleys in the display area.
l. obstructing Museum staff in the performance of their duties or otherwise impeding the operation of the Museum;
m. being under the influence of alcohol or other intoxicants on the Museum premises, behaving in a manner that poses a threat to the safety of other persons or exhibits, annoying behaviour towards other Visitors, causing disturbances to public order, deviating from the accepted norms of personal hygiene;
n. to organise public assemblies, public meetings, carry out commercial activities, distribute advertising or announcements or carry out any other commercial activity without the express prior consent of the Museum.
11) The employees of the Museum may admonish a Visitor who violates these Regulations, giving the reason. In the case of a repeated, persistent or flagrant breach of these Regulations or of the provisions of the law in force during their stay in the Museum, the Visitor may be asked to leave the Museum, to which they shall immediately comply.
12) Whenever it is necessary to maintain order or protect the security of persons and property in the Museum, Museum staff are authorised to take any action permitted by law to remove a person from the Museum premises, in particular when that person is under the influence of alcohol or other intoxicants or when their behaviour poses a threat to other Visitors.
13) Any perceived irregularities and safety-related remarks can be reported by the Visitors according to the complaint procedure specified in § 6 of the Rules and Regulations.
§ 4. TAKING OF PHOTOGRAPHS AND FILMS
1) Museum exhibits may be subject to the protection of generally applicable laws, in particular the Act of 4 February 1994 on Copyright and Related Rights.
2) Visitors may use the exhibits, including taking photographs and films, only in accordance with the above-mentioned legal regulations, including copyright law, i.e. in particular for the Visitor's own private use. The Visitor is not entitled to any additional rights to use the exhibits beyond what results from the following
mandatory provisions of copyright law, in particular the institution of fair use.
3) It is forbidden to photograph or record the surveillance (monitoring) system of the Museum.
4) Taking photographs and making recordings in the Museum for purposes other than private, in particular for commercial purposes and as part of a paid activity, requires the express and prior consent of the Museum. Information in this regard can be obtained by contacting in accordance with the contact details indicated at the beginning of the Regulations.
§ 5. PERSONAL EFFECTS
1) A cloakroom, which is free of charge and unsupervised, is available to visitors on the Museum premises. The cloakroom is intended for the storage of personal belongings, including outerwear, for the duration of a visit to the Museum. Cloakrooms should not be used for storing valuable, valuable objects and valuables. Visitors should take such items with them wherever possible and not leave them unattended.
2) Storing Visitors' belongings in the locker room is only permitted for the duration of their visit to the Museum. At the end of their visit, Visitors are required to empty their lockers of all personal belongings.
§ 6. COMPLAINTS ABOUT THE MUSEUM
1) This § 6 of the Regulations sets out the procedure for dealing with complaints common to all complaints submitted in connection with the Museum's activities.
2) The basis and scope of the Museum's liability towards Visitors, in particular for any inconvenience related to their visit, are defined by generally applicable laws, in particular the Civil Code and the Consumer Rights Act of 30 May 2014.
3) Complaints can be submitted directly to the owner of the Museum, in particular in writing to the address: ul. Łucka 15/3, 00-842 Warsaw or by e-mail to: cosmosmuzeum@gmail.com.
4) It is recommended that all complaints and grievances related to a particular visit to the Museum are reported directly during the visit or immediately after the visit - this will facilitate the processing and execution of the complaint in the least burdensome manner for the Visitor.
5) Visitors are requested to include in the description of their complaint: (1) information and circumstances concerning the subject of the complaint, in particular the nature and date of the irregularity; (2) their expectations; and (3) the contact details of the complainant - this will facilitate and speed up the handling of the complaint by the Museum owner. The requirements given in the preceding sentence are in the form of a recommendation only and do not affect the effectiveness of complaints submitted without the recommended description.

6) If the contact details provided by the complainant change during the processing of the complaint, the complainant is obliged to notify the Museum owner.
7) Evidence (e.g. photographs, documents) relating to the subject of the complaint may be attached to the complaint by the complainant. The Museum Proprietor may also request the complainant to complete or provide additional information and send evidence (e.g. photographs) if this will facilitate and expedite the processing of the complaint.
8) The Museum Proprietor shall respond to the complaint immediately, but no later than within 14 calendar days of receipt.
§ 7. OUT-OF-COURT MEANS OF DEALING WITH COMPLAINTS
1) Detailed information on the possibility for consumers to use out-of-court complaint and redress procedures, the rules of access to these procedures and a user-friendly search engine for amicable dispute resolution entities is available on the website of the Office of Competition and Consumer Protection at: https://polubowne.uokik.gov.pl/.
(2) The consumer has the following examples of out-of-court complaint and redress procedures: (1) an application for dispute resolution to a permanent amicable consumer court; (2) an application for out-of-court dispute resolution to a provincial inspector of the Commercial Inspection; or (3) the assistance of a district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection
(e.g. Federation of Consumers, Association of Polish Consumers). Advice is provided, inter alia, by e-mail at porady@dlakonsumentow.pl and at the consumer helpline number 801 440 220 (the helpline is open on working days from 8:00 a.m. to 6:00 p.m., call charge according to the operator's tariff).
§ 8 PERSONAL DATA (RODO)
1) In the case of the processing of Visitors' personal data in connection with their stay at the Museum, the controller of their personal data is the owner of the Museum (hereinafter referred to as the "Administrator"). Full details of the Administrator, including his/her contact details, are indicated at the beginning of these Regulations. The Administrator has not appointed a Data Protection Officer.
2) Visitors' personal data are processed by the Administrator in accordance with the applicable legislation, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) - hereinafter referred to as "RODO" or "Regulation
RODO".
3) This information is provided on the basis of Article 13 of the RODO Regulation and concerns the situation in which the Controller collects personal data from the data subject. In the case of a visit to the Museum, the processing of Visitors' personal data may take place in the following cases:
a. The Visitor purchases a Ticket and/or reserves a visit to the Museum and for this purpose provides his/her personal data.
➢ Purpose: performance of a contract or taking action at the request of the data subject before entering into a contract.
➢ Legal basis: article 6(1)(b) of the RODO Regulation (performance of a contract).
➢ Period: The data shall be stored for the period necessary for the performance or otherwise termination of the legal obligation under the contract.
b. The visitor shall make use of the complaints procedure and shall provide personal data as part of this procedure.
➢ Purpose: fulfilment of the Visitor's contractual rights of complaint.
➢ Legal basis: article 6(1)(b) of theRODO Regulation (performance of a contract).
➢ Period: The data shall be stored for the period necessary for the performance or otherwise termination of the legal obligation under the contract.
c. The visitor wishes to receive a bill or invoice and shall provide personal information for this purpose.
➢ Purpose: bookkeeping.
➢ Legal basis: article 6(1)(c) of the RODO Regulation in conjunction with article 74(2) of the Accounting Act, i.e. of 30 January 2018. (Journal of Laws of 2018, item 395 as amended).
➢ Period: the data shall be retained for the period required by law requiring the Administrator to keep the accounts.
d. The Visitor or the Administrator addresses contractual claims to the other party other than in the context of a complaint procedure (e.g. for non-payment) and to this extent the Visitor's personal data are processed.
➢ Purpose: to establish, assert or defend claims that the Administrator may raise or that may be raised against the Administrator.
➢ Legal basis: article 6(1)(f) of the RODO Regulation (legitimate legal interest of the controller).
➢ Period: The data shall be stored for the period of existence of the legitimate interest pursued by the Controller, but no longer than the period of the statute of limitations for claims against the data subject in respect of the Controller's business activities.
e. The visitor has consented to the processing of the data provided by the visitor for one or more specific purposes (e.g. marketing).
➢ Purpose: determined in each case by the scope of the Visitor's consent, e.g. the Museum's own marketing or that of its partners, information on events and promotions, etc.
➢ Legal basis: article 6(1)(a) of the RODO Regulation (consent).
➢ Period: Data shall be stored until the data subject has withdrawn his/her consent to further processing of his/her data for this purpose.
f. Monitoring of the Museum - in this scope the images of persons present in the Museum may be processed (the Administrator using monitoring respects the privacy of Visitors in areas of heightened expectation of privacy, e.g. toilets).
➢ Purpose: to protect the safety of persons and property; to record evidence in case a crime is committed on the premises.
➢ Legal basis: article 6(1)(f) of the RODO Regulation (legitimate interest).
➢ Period: Data are stored for a period of 14 days, i.e. until the monitoring device overwrites the material recorded so far. If unlawful activity is recorded, the processing of the selected material continues until the case is clarified by the competent authorities or the relevant proceedings are completed in accordance with the applicable legislation.
4) Apart from the above situations, the Administrator does not collect or process Visitors' personal data during their stay at the Museum. In principle, the provision of personal data is also not required for the purchase of Tickets (subject to online booking in accordance with the privacy policy available on the Museum website). However, if the Visitor wishes to make use of the complaints procedure or wishes to receive a named bill or invoice, the provision of the necessary data is, in this case, necessary in order to fulfil the Visitor's entitlements. Personal data is collected in
such situations from the data subject.
5) The transfer of Visitors' personal data to other recipients by the Museum may only take place in the situations specified above. The transfer of data by the Museum does not take place in every case and not to all of the recipients or categories of recipients indicated below - the Museum transfers data only if this is necessary for the purpose of the processing of personal data in question and only to the extent necessary for the purpose. For example, if it is necessary to use an accounting firm to issue an invoice, the Museum transfers the data to its accounting firm in order to issue the invoice. The Museum only uses such processors that provide sufficient guarantees for the implementation of the
appropriate technical and organisational measures so that the processing meets the requirements of the RODO Regulation and protects the rights of data subjects.
6) Personal data may be transferred by the Museum to the following recipients or categories of recipients: (1) accounting, legal and advisory service providers providing accounting, legal or advisory support to the Museum (in particular an accountancy firm, law firm or debt collection agency); (2) technical service providers,
organisational and IT arrangements that enable the Museum to conduct its business, including the handling of bookings and Ticket sales (e.g. email providers, software providers to handle bookings and Ticket sales, service providers to assist with promotional and marketing campaigns
etc.). The Museum shall make the collected personal data of the Visitor available to the selected supplier acting on its behalf only in the case and to the extent necessary to fulfil the respective purpose of data processing.
(7) The data subject has the right: (1) access, rectification, restriction, erasure or portability of his/her personal data in the manner and procedure specifically set out in the RODO; (2) to withdraw his/her consent at any time, where his/her personal data are processed on the basis of consent, without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal; (3) to lodge a complaint with a supervisory authority in the manner and procedure set out in the provisions of the RODO and Polish law; (4) to object, including objection to direct marketing, where his/her personal data are processed on the basis of Art. 6(1)(f) RODO (legitimate interest of the controller).
8) In order to exercise the rights referred to above, the Administrator may be contacted in person or by sending an appropriate message in accordance with the Administrator's contact details indicated at the beginning of the Regulations.
§ 9. FINAL PROVISIONS
1) The amendments to the Rules and Regulations shall in no way affect the acquired rights of Visitors prior to the effective date of these amendments, in particular the amendments to the Rules and Regulations shall not affect already purchased Tickets.
2) Matters not covered by these Regulations shall be governed by the generally applicable provisions of Polish law, in particular the Civil Code and the Consumer Rights Act of 30 May 2014.
